Grounds for a Medical Malpractice Case
If a patient alleges clinical negligence, they are saying their medical practitioner has not preformed standard treatment and has caused some form of injury. Medical negligence or medical malpractice are other terms that might be used to describe this type of occurrence. This injury can be either emotional or physical and it is now having a serious impact on the patient’s life. This is when the patient will contact a clinical negligence solicitor to see if they have grounds for a case.
Many things can cause this type of injury. Maybe a surgery was poorly done or a medical device had failed and either one of these can certainly cause an injury. Perhaps a medication was incorrectly given or the wrong treatment was prescribed. A mentally ill person who was incorrectly diagnosed for years could have a case but this one would be hard to prove.
Most clinical negligence cases will find a financial liability amount for the mistake made by the practitioner. What kind of amount can be put on someone who was not treated correctly? This is a question that will be answered by the solicitors who are assisting in the case. Some cases will go to trial but most do not as they are often settled out of court.
